DEFINITIONS & AGREEMENT BETWEEN PARTIESThese terms and conditions (the "Agreement") constitute a legally binding agreement between: You, the end user; and GameVillage Ltd. ("GameVillage") 3rd Floor Regional Building Msida, Malta; and Betsoft Gaming Ltd. Nicosia, Cyprus ("BetSoft") our 3rd party casino games provider. GameVillage's online gaming portal ("Games") is located at www.GameVillage.com and related sub domains as they are released on our network. Games operate on the basis of an underlying software system designed by our in house technology team and where necessary other third party software licensing partners. In this Agreement GameVillage is referred to as the "Service Provider". This Agreement is between you and the Service Provider. The Service Provider may enforce any of their respective rights or powers set out in this Agreement against you directly. The purpose of this Agreement is to regulate the legal relationship between you and the Service Provider in relation to your use of the Games and the Software. If you have any questions, the Service Provider encourage you to seek independent legal advice in your jurisdiction prior to clicking on the "ACCEPT" button/checking any box to indicate your acceptance of terms. By clicking on the "ACCEPT" button/checking any box to indicate your acceptance of terms and/or continuing to access and/or use the Games. You are legally bound by this Agreement. GameVillage operates the Games by virtue of a provisional license granted to it by the Lotteries and Gaming Authority ("LGA") in Malta. For further information about the LGA please go to www.lga.org.mt. You agree to fully indemnify the Service Provider and hold the Service Provider harmless from and against all and any losses, costs, expenses, claims, demands, liabilities and damages however caused that may arise directly or indirectly as a result of your (a) use of the Games or (b) acceptance of any winnings or (c) any breach of this Agreement. If you breach this Agreement or a Service Provider has any reasonable grounds for suspecting that you have breached the Agreement, in addition to any other remedies available to the Service Provider, (on behalf of GameVillage) may withhold payment of your winnings on account of any damages or other amounts owed by you to the Service Provider.
WAGERING TERMSIn order to play for real, a player must wager from funds that are in their member account maintained by the Operator. In no instance would wagering with prize points entitle a player to win cash jackpots or prizes. Similarly all wagering is void if on review the player has never successfully deposited funds into their account, nor received a bonus. In order for a wager to be valid you must receive confirmation from us that the wager has been made. A confirmation message will appear on the screen. The wager will have been deemed confirmed when it registers on your Account Details page, accessed via the "My Account" button at the bottom of the screen. The Operator cannot cancel wagers once they have been confirmed by the Operator in your account unless the wager is declared void for reasons outlined in these Terms Despite every effort to ensure total accuracy, we do not accept responsibility for any errors or omissions in respect of information provided on the site. Wagers based on incorrect odds will be void. Stakes (the cost of a wager) will be deducted from your account at the time of placing your bet, no matter when the result is determined. The Operator cannot refund bets placed on games where bets have been purchased for future draws that have not yet been resolved. Such bets will be resolved and winnings credited to players bank accounts. Players who have not made a deposit may not use free bonus money to wager on Casino or Wild Cherries games. No free bonus money will be added to game pots until a player has made a first deposit at which point all money wagered is added to the game pots.
BONUS TERMS(i) First time deposit bonus - we match the players first ever deposit in our system by 200% up to a maximum of £100. (ii) Refer a Friend Bonus - Once a player makes a deposit they can refer someone to the site. When the referred player makes a deposit both players are paid a £25 bonus. The £25 bonus can not be withdrawn. Any winnings from the bonus can be withdrawn once initial wagering requirements have been met. (iii) Chat room bonuses - we pay cash bonuses to winners of chat room promotions. If all wagering requirements have been met previously, the chat room promotion bonuses are not subject to any further wagering requirements. (iv) Cash Back Tournaments - we offer periodic 'cash back' tournaments where top wagering players in set time periods and on set game types win a % of their wager less winnings. (v) Bonus Restrictions - players using bonus money outside of depositing players may not chat in any game rooms until they become official depositing members. (vi) Free Cash Bonus - A free cash bonus of £20 is available to anyone who registers a card for the first time at the site. (Neteller users can claim this free bonus after their first deposit). Players are required to wager 4 times the amount of any free cash bonus before they can make a withdrawal. A free cash bonus of £10 would require the player to wager £40. Wagering requirements exclude all wagers on Casino games.
No withdrawals can be made from an account where the player has never deposited, nor is any withdrawal honoured for winnings derived from players with multiple accounts. (vii) Cash Match Bonus - A 200% cash match bonus on all first time deposits up to £100 is available to anyone who deposits for the first time at the site. (250% if the first deposit is made within 24 hours of the account being opened) (viii) Cash Withdrawals - see our Cashier Policies for details on bonus money and player withdrawals. (ix) Deposit Bonus GameVillage will give a Deposit Bonus on occasions, the % of which may vary. The Terms and Conditions for this bonus are that a player must wager 2 x their deposit plus bonus added before they can withdraw without losing the bonus. Casino wagers will not count towards wagering requirements, only wagers made on Bingo, Dingo and SuperGems. For example, deposit £10, receive a 100% Deposit Bonus of £10, the wagering requirements would be £10 + £10 x 2 = £40. The Deposit Bonus may never be withdrawn but any winnings may be once the wagering requirements have been met. First time depositors are not eligible for a Deposit Bonus, a Cash Match Bonus applies to first time deposits.

Withdrawals larger than £5,000 may take slightly more time to process and are based on your payout option at the time of request. LIMITS OF LIABILITYThe games and the software are provided to you 'As Is', without warranty of any kind, either expressed or implied, including, but not limited to, implied warranties. You shall defend, indemnify, and hold the Service Provider, their parents, subsidiaries, partners (including anyone else involved in creating, producing or delivering the Games or the Software), affiliates, directors, officers, employees, and representatives harmless from and against any and all claims, demands, liabilities, losses, damages, costs and expenses, including legal fees, resulting from, arising out of, or in any way connected with: your misuse of the Games or the Software, any breach of this Agreement by you, your acts or omissions, the enforcement or protection or clarification of the Service Provider' rights under this Agreement, the processing, reversal or adjustment by any transaction and/or for any failure by the Service Provider and/or delays (however caused) incurred in the processing, reversal or adjustment of any transaction.
CHAT ROOMSChat Rules Chat is available to players who have deposited only. All chat must reflect the operator's standards and we reserve the right to remove or restrict a user's chat as we deem necessary and close accounts after reviewing incidents of unacceptable behaviour. Virtual VillageHome Ownership To become a homeowner in the Village a player must make 3 initial deposits and then make at least 1 deposit within 30 days of their last deposit to keep the same home. The players home will be reserved for a further period of 30 days after it has been removed and then returned to the player if a deposit is made. If a player does not make a deposit for 60 days they will lose their original home. House Party Promotions To take part in House Party Promotion the player has to be a homeowner. If the player loses their home in the middle of a promotion they will not qualify for any part of the promotion prize at the end of the promotion.
TERMINATING AGREEMENTThis Agreement is effective from the date you click on the "ACCEPT" button/you check the acceptance button or otherwise indicate acceptance of these terms and it shall continue in effect until terminated in accordance with its terms. The Service Provider (or any of them) may restrict your access to the Games, suspend your Games account or terminate this Agreement at any time and for any reason whatsoever in their sole and absolute discretion with or without notice to you. In particular the Service Provider (or any of them) may immediately restrict your access to the Games, suspend your Games account or terminate this Agreement without notice if:
You may terminate this Agreement at any time by prior written notice to GameVillage. (support@gamevillage.com) On termination of this Agreement any balance in the Games environment (if applicable) will be returned to your GameVillage account within a reasonable time of your request subject always to the Service Provider' right to deduct any amounts owed by you to the Service Provider and any applicable transaction charges from such balance before remittance to you. If this Agreement is terminated as a result of your default then you will be liable to the Service Provider for any damages suffered by any of them. Deactivation of Accounts - All accounts which remain inactive for a period of 30 months will be closed and this agreement deemed void. Steps will be taken to contact the registered user to refund any outstanding balance, if the user can not be contacted the outstanding balance will be paid to the LGA.
TERRITORIAL ISSUESUSE OF GAMES IS LEGAL IN THE LOCAL JURISDICTION. If your use of the Games is illegal you may not be entitled to collect any winnings and the Service Provider reserve the right to recover any winnings already received by you and/or by anyone acting on your behalf and to report you to the relevant authorities. GameVillage will not allow residents of the United States or Canada to become depositing players. YOU ARE NOT PERMITTED UNDER ANY CIRCUMSTANCES TO PLAY GAMES FROM THESE COUNTRIES. Anyone attempting to bypass our blocking mechanisms will forfeit their accounts and any winnings they may have attained from the site. The Games are only available to you if use of online Games is permitted in your Local Jurisdiction. It is up to the player to determine their local laws pertaining to this matter. This Agreement shall be governed by the laws of Malta as are in force from time to time. By accepting this Agreement, you agree to submit to the exclusive jurisdiction of the location that the relevant Service Provider determines in its sole discretion in respect of any disputes arising out of, or connected with, this Agreement. Nothing in this paragraph shall prevent the Service Provider from applying to the courts of any jurisdiction for such provisional or protective measures as are available under the laws of that jurisdiction. The Service Provider does not intend that anyone should use the Games where such use is illegal. The availability of the Games does not constitute an offer or invitation by any Service Provider to use the Games in any country in which such use is illegal. Use of the Games and participation in games may be voided (in the absolute discretion of GameVillage) wherever prohibited by any applicable law. You can only use the Games if you are of the legal age of majority as determined by the law of the country where you live and/or access the Games from (the "Local Jurisdiction"). You cannot use the Games if you are under 18 years of age in any circumstances.
GAME DISPUTESThe Service operates "AS-IS" and "AS-AVAILABLE," without liability of any kind. We are not responsible for events beyond our direct control. Because of the complex and constantly changing nature of our technology and business, we cannot guarantee nor do we represent that there will be error-free performance regarding the game systems at all times. We will endeavour to provide our players with the utmost fairness on all game related payout disputes related to wagering and game results. However, from time to time should a game malfunction and payout inappropriate values that are completely beyond our control and need to be removed from the site for further testing and correction, GameVillage Ltd. and/or it's management reserve the right to cancel or negotiate payout matters related to said games. To date this has never been an issue in our game system. If there is any discrepancy between the gaming results on your computer and the results on the game server for the Games, the results on the game server for the Games shall be final and binding. If there is any discrepancy between your on-screen display and the balance in your Games Account, the balance held on GameVillage's server is deemed to be the balance in your Account and this determination shall be final and binding. You will forfeit any amounts shown to be in your Account that result from human error or technical default. If you are incorrectly awarded any winnings as a result of (a) any human error on the part of the Service Provider or (b) any bug, defect or error in the Software or (c) the failure of the Games or the Software to operate in accordance with the rules of any of the Games's games then the Service Provider will not be liable to pay you any such winnings and you agree to refund any such winnings that may have been paid to you as a result of such error or mistake. If during a dispute the player supplied information, data or images do not correspond with the information stored in the Service Provider database, the database information will be assumed to be correct in all cases. No player supplied information, images or data will be considered for determining results of transactions or game results. GameVillage reserves the right to refuse or limit any wager in its sole discretion. If the Service Provider find any evidence or has any suspicion that you have attempted or intend to breach any of the foregoing terms or have otherwise tampered or will otherwise tamper with the Software or the operation of the Games in any way, in addition to any other remedies available to it, they may withhold payment of your winnings. In addition GameVillage reserves the right not to transfer your account balance to your GameVillage account where we suspect the account has been linked with fraudulent or dishonest activity or funds used originating from criminal or illegal activity or where we have to withhold the funds by law or to comply with any advice, request or instruction from any governmental, regulatory or enforcement authority. As part of the Games, GameVillage may offer other games and/or services from time to time. Games games will be operated and played in accordance with the rules of the LGA as applicable. GameVillage may, in its absolute discretion, alter or amend or withdraw any game from the Games or any part thereof, at any time, and may alter prices, features, specifications, capabilities, functions and/or other characteristics of the Games, or Games games. Aborted and Miscarried Games - Any player making a wager on a game which fails to start or fails to play through to its expected conclusion on our servers, such conclusion being the one described in the rules for each game, will be refunded their original wager. A player who has accrued credits in a game which starts but fails to reach a final conclusion will be paid the amount of credit accrued when the game miscarried. Any player making a wager on a game which starts, plays through and reaches a final conclusion on our servers will not be refunded their original wager. Any winnings on such wagers will be paid to the players account regardless of whether the player actually saw the game play. The results for these games will be stored on our database and these results will be deemed to be correct.
SOFTWARETitle, ownership and all intellectual property or other proprietary rights in the Software belong to GameVillage Ltd., including any images, photographs, animations, video, audio, music and text, that may be part of Software. Software in source code form is the trade secret and confidential information of GameVillage. All rights not expressly granted to you under this Agreement in respect of the Software are reserved to GameVillage. The Software is protected by all applicable intellectual property laws and international treaty provisions. Title, ownership and all intellectual property or other proprietary rights in the Games are licensed to GameVillage. You shall not acquire any rights, interest in or title to any such intellectual property rights in the Games. The copying, redistribution or publication of any part of the Software is strictly prohibited. You will not sell, assign, sub-license, transfer, distribute, rent or lease the Software and you will be solely liable for any and all damages, costs and expenses arising from such unauthorised sale, assignment, distribution, renting or leasing thereof. You will not make the Software available on a computer network or otherwise make the Software available to any third parties without the prior consent of the owner and/or licensor of the Software. Other than as expressly permitted by applicable law, you will not copy, reverse engineer, decompile, disassemble, modify, translate, or make any attempt to discover the source codes of the Software or create derivative works based on the Software, and you will be solely liable for any damages, costs or expenses arising from the above. You will only use the Software for the purposes contemplated by, and in accordance with the terms of, this Agreement. If you become aware that the Software is being used in any manner not authorised by this Agreement or otherwise, you will immediately notify the Service Provider. You agree that you will not use the Software for any unlawful purposes or for the purposes of sending or transmitting any data or other material:
You acknowledge and agree that the Software and any related documentation or other materials provided by the Service Provider are the confidential information of the Service Provider. You agree not to disclose such confidential information to outside parties without the consent of the Service Provider owning such confidential information. You shall only use confidential information for the purposes of this Agreement. Your obligations with respect to confidential information shall survive termination of this Agreement. The Service Provider may develop or issue upgraded versions of the Software from time to time and may make such upgraded versions available to you in their sole discretion. All such upgrades shall be deemed to be Software for the purposes of this Agreement. If you use multiple browsers or attempt to manipulate or ascertain information concerning the Games software code or are involved in collusion, you will forfeit all money and be deactivated as a player. All wagers must be placed through the user interface provided on the Games. Any wagering through other means, including the use of a "robot" player, is strictly forbidden without the express consent of GameVillage. The Service Provider reserve the right to prohibit any player from participating in any and all games, and may, where situations warrant, freeze the accounts of any player suspected of cheating in any form. The Service Provider further reserve the right to restrict seating and/or to prohibit players from playing in a particular game, including restricting two or more players from playing together at the same game. You acknowledge that use of the Games confers no rights whatsoever to the intellectual property rights in the Games. You hereby assign to GameVillage Ltd. any intellectual property rights (including without limitation copyright and database rights) in any bets, chat postings, game play or any other interaction made by you whilst using the Games. GameVillage makes no representations or warranties of any kind, including but not limited to, the accuracy, quality or completeness of the information. GameVillage shall not be liable for any action taken by you as a result of your relying on any information referred to above or for any loss or damage suffered by you as a result of you using such information or any third party website linked to from GameVillage. Any links from the Games website to third party websites do not constitute an endorsement by GameVillage of any products or services available on such websites. You use such websites at your own risk and GameVillage takes no responsibility for the content on, or use of, such websites.

We may disclose your Personal Information if required to do so by law, or if we believe in good faith that such action is necessary to: (1) comply with any legal process served on us, the Website or the Service; (2) protect and defend our rights or property; or (3) act to protect the personal safety of users of the Service or the public. If, in our sole determination, you are found to have cheated or attempted to defraud the Company or any other user of the Service in any way including but not limited to game manipulation or payment fraud, or if we suspect you of fraudulent payment, including use of stolen credit cards, or any other fraudulent activity (including any chargeback or other reversal of a payment) or prohibited transaction (including money laundering), we reserve the right to share this information (together with your identity) with other online gaming sites, banks, credit card company's, and appropriate agencies.
